1. About Floa

Floa began in Christchurch, New Zealand, formed within a group of young people who felt increasingly disconnected from the version of wellness being presented to us. What was marketed as health often felt fragmented and performative.

Through exploring older systems of knowledge and holistic traditions, we were drawn to perspectives that understand the body as interconnected — where rhythm, environment, and daily choices shape wellbeing over time.

Floa was built from that understanding. We formulate and sell wellness tea blends guided by long-term thinking, respect for origin, and integrity in sourcing.

For the purposes of these Terms, “Floa”, “we”, “us” and “our” refers to Floa, Christchurch, New Zealand.


2. Acceptance of Terms

By accessing or using the Floa website (“Website”), purchasing our products, or engaging with our services, you agree to be bound by these Terms & Conditions.

We may update these Terms from time to time. Continued use of the Website constitutes acceptance of any changes.
 

3. Governing Law

These Terms are governed by the laws of New Zealand.

You agree to submit to the non-exclusive jurisdiction of the courts of New Zealand.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
 

4. Health & Product Disclaimer

Floa produces herbal and wellness tea blends intended to support general wellbeing.

Our products:

  • Are not intended to diagnose, treat, cure, or prevent any disease.

  • Do not replace professional medical advice.

  • May not be suitable for individuals who are pregnant, breastfeeding, taking medication, or managing medical conditions.

You should consult a qualified healthcare professional before use if you have health concerns.

To the fullest extent permitted by law, Floa is not liable for misuse of products or failure to follow preparation instructions.
 

5. Consumer Rights (New Zealand Customers)

Nothing in these Terms excludes, restricts, or modifies any rights you may have under:

  • The Consumer Guarantees Act 1993 (NZ)

  • The Fair Trading Act 1986 (NZ)

Under the Consumer Guarantees Act, you are entitled to remedies if goods are faulty, not as described, or not fit for purpose.

Where permitted by law, our liability is limited to:

  • Replacement of the goods

  • Repair of the goods

  • Refund of the purchase price

at our discretion.
 

6. Accuracy of Information

All content on this Website is provided in good faith. While we aim to ensure accuracy, we do not warrant that:

  • Product descriptions are error-free

  • All information is current or complete

  • Website access will be uninterrupted or secure

Your use of the Website is at your own risk.

We reserve the right to correct errors, inaccuracies, or omissions and to cancel orders placed based on incorrect information.
 

7. Orders & Payment

All prices are listed in New Zealand Dollars (NZD) and include GST unless otherwise stated.

Payment must be received in full before dispatch.

We reserve the right to:

  • Refuse or cancel any order

  • Limit quantities

  • Correct pricing errors

Risk of loss passes to you once goods are delivered to the carrier.
 

8. Shipping & Delivery

Delivery timeframes are estimates only.

Floa is not responsible for delays caused by:

  • Courier services

  • Customs clearance

  • Events beyond our reasonable control

International customers are responsible for any applicable duties or import taxes.
 

9. Returns & Refunds

If a product is faulty, please contact us promptly so we can arrange a remedy in accordance with New Zealand consumer law.

For change-of-mind returns:

  • Requests must be made within 14 days of delivery

  • Due to hygiene and food safety regulations, opened tea products cannot be returned unless faulty

Return shipping costs are the responsibility of the customer unless the item is faulty.
 

10. Intellectual Property

All content on the Website, including text, imagery, branding, logos, formulations, product names, and design elements, is the property of Floa and is protected under New Zealand and international intellectual property laws.

You may not reproduce, distribute, or use any content for commercial purposes without prior written consent.
 

11. User Accounts

If you create an account, you agree to:

  • Maintain the confidentiality of your login credentials

  • Accept responsibility for activity under your account

We reserve the right to suspend or terminate accounts that provide false information or breach these Terms.

  • We are not responsible for viruses, system interruptions, or third-party interference.

Nothing in these Terms limits rights that cannot legally be excluded under New Zealand law.

Floa does not control or endorse third-party content and is not responsible for any loss or damage arising from use of third-party websites.
 

15. User Contributions

If you submit reviews, comments, or other content:

  • You grant Floa a non-exclusive, royalty-free, worldwide licence to use, reproduce, and publish that content.

  • You confirm that your content does not infringe on the rights of others.

We reserve the right to remove content at our discretion.

We take reasonable steps to protect your information. However, no internet transmission is completely secure.

Floa will never request sensitive financial information via email.

We collect and handle personal information in accordance with the Privacy Act 2020 (NZ).
